"The" ra-ptdly increasing divorce rate". remarked the w1t-:--'~~d1.cates ----that America is indeed becoming the "land of the free."
"Yes", replied his prosaic friend, "but the continued marriage rate
suggests that it is still the home of the brave."

Llttle dld we suspect what was ln store for us when-Paullne
ELNIFF and I declded one day last fall to undertake the task of r
abstractlng early Douglas County dlvorce records. In the flrst
place. we dld not reallze what an lmmense project lt would be.
There belng no lndex solely for dlvorce cases. lt was flrst necessary
to slft through the Index of Clvll cases located at Spencer Research
Llbrary on the Unlverslty of Kansas campus where many of the older
court records are kept. We were looklng for cases ln whlch both
plalntlff and defendant had the same surname. Then. armed wlth
names. Case numbers and our natural curloslty. lt was down to the
storage basement at the Judlclal and Law Enforcement Bulldlng where
the old case flIes of Cl vll and Crlmlnal cases are stored ln metal ~<-;'.
cablnets. Some of the flIes had surely not been opened slnce they
were placed there a century or more ago judglng from the amo~t of
dust on them.
As we read each case. we were struck wlth the polgnancy of
partlcular stQrles. amazed at the contemporary nature of others,
but m~~nly surprlsed by the wealth of genealoglcal lnformatlon
avallable. After readlng numerous cases. we came to the concluslon
that dlvorce records are probably the most o(tlsunderstood and least
utlllzed records avallable to genealoglsts. Why? Because we do
no usually even conslder that one of our ancestors may have been
dl vorced.
Just thlnk about your own famlly tree. Sltuatlon I: Your
great-grandmothermarrled your great-grandfather and 11ved together
happlly untl1 death dld them part. You have seen thelr marrlage
certlflcate whlch shows your great-grandmother's malden name. There
ls nothlng to make you suspect that she may have been prevlously
marrled and dlvorced. So, "Why check dlvorce records?" Answer:
Our experlence readlng early Douglas County dlvorce cases has taught
us that many of the women marrled flrst uslng thelr malden name,
got a dlvorce ~ a return of thelr malden name, and marrled someone
f!1lse uslng thelr malden ruune agalnL (Some women ;;"'o~$n:::;.the other· hand •

. dl voroe' record.s· in" yoUr ance-stor l-s- county justln 'case there was
a prevlousmarrlage and dlvorce.
'fh.tuatlon II. You know that one of your great-grandfath~rs
was married twlce, but you and your famlly have always assumed that
hls flrst wife dled shortly after marrlage and he then remarrled.
So, "Why check dlvorce records?" Answer: You may f1nd as we dld
that many men were marrled a flrst tlme, dlyorced a year or two
later, and then remarr1ed ln a year or so to someone els~. Even
though some of the dl vor oed men' s bl0graphlcal sketche.s, t~."a:;::<?c:)l¢~Y::...

Situation III: You are absolutely sure that there are no
divorces in your family, so "Why check early divorce records?"
Answer: While it may be true that you are unlikely to find an
ancestor who was divorced, it is quite pro:pable that one or more ~
ot your ancestors may have been subpoened in a divorce case as
witness for.either the plaintiff or defendant. If so, your
ancestor's depositia'lmay, give innumerable facts about himself
arid otherrelatlves. ·.I~tor:a;hc::'~'Ch'eck early divorce records,;;-fol!.::~l),Qssi ble
mention of your ancestor no matter fr9m what social level he came. _,~~
We found deposit10ns of witnesses from every economic and social level
of the communi ty., in the Douglas County divorce records.
NOW ••• lf we have convinced you t9 cons1der checking divorce
records, here are some of the treasures wh1ch may await you:
Name of the plaintiff and defendant; the date and place of their,
marriage; wife's maiden name; children's names and ages; grounds
for the divorce (if adultery-sometimes giving the name of the other
person involved), (1f b1gamy-somet1mes gi1V1ng name and marr1age date
of f1rst spouse), (1f cruelty or neglect-somet1mes g1ving dates and
places of incidents 'of phys1cal or verbal abuse); military serv1ce;
somet1mes real and personal property. occupations, ages, names of
other relatives; letters or other papers in defendant's own writing
answering allegations; newspaper notices of the pending divorce;
names of sheriffs and other off1cials; and many other items of interest
relat1ng to customs of the times and local h1story.
In one:'~trouQYll~ng letter from a soon-to-be divorced woman of
Douglas Courity"tc{'the Clerk of Court in 1864. we read the following:
1f it must be so i will g1 ve him a bill of d1 vorce. but ,:. ,';.." .
would rather 11ve and enjoy l1fe happily with h1m than do ",.
soc~,and lf the1r is any mercey in heaven and just1ce in law

.

. .-: If you've traced an ancestor to the' East coast of the United
States and the trail has gone cold without a clue as to where
the family came from. there is a strong possibility that they or
their parents emigrated from Bermuda. Bermudians have been
establishtng new family lines in the United States and Canada,
since Bermudars colonization in 1612.
Although every conceivable English name that. exists in the U.S.
also exists in Bermuda. your chances of conn~eting with a Bermuda
ancestor are particularly good if you are searching for a name
somewhat less common in this country, or even rare. Some of
those names listed below are (or were) common in Bermuda:

The earliest jail in Lawrence was a 20 X 20 foot log structure built
in 1858. County commissioners. Josiah MILLER and William BARRICKLOW
were instrumental in securing funds with which to build the log jail.

park and was the first iron jail in Kansas. According to an article
in the Journal WOEld dated Oct 7 1937, the iron with which the jail
was constructed was put on the steamboat. "Izetta" enroute to Lawrence
but the "Izetta" became stuck on a sand bar at De Soto and the iron
had to be unloaded and brought the rest of the way by wagons.
According to the Republlca'n Journal. Lawrence. KS. Apr 27 1871 issue,
a reporter who visited the jail in April of 1871 described a cellon
the NE corner of the 2nd floor as IIdirty and squalid". Although the
cell did contain a chair and desk, the mattress was ~escribed as being
only one inch in thickness. Some of the prisoners whom the reporter
saw on his visit were: Dr. John MEDLICOTT, charged with the murder of
of Mr. I.M. RUTH ;"'the notorious I Cinda. Alex MONTGOMERY; SPRIGGS, the
crazy man; a Folish lunatiC; two vagrants. one petty larceny (six
months) and one attempt to kill (six months) ."
The Douglas County courthouse was built in 1903 on the S.E. corner of
Massachusetts and 11th St. A few years later the jail was located in
a building :;.;::I?;.~':ot the courthouse where it remained until the construc't;
tion of the new J"udicial and Law Enforcement Building adjacent to South
Park in 1976.
On the following pages are the names of those persons listed 1n the

Crim1nal Appearance Docket Book 1(1863-1878). Much 1nformat1on can
be gleaned from the actual files which are stored 1n the basement of
the Judicial and Law Enforcement Build1ng. Due to shortages of staff
1n the District Court Office able to do research of th1s nature, it 1s
suggested ~hat ~n~e.~ested. persons contact the DCGS ff. fur..ther.;-:1nformat..:

The Lawrence Journal World. Nov 22,198) issue reported the effort's
of Amelia BETTS of Baldwin City. KS to restore seven monuments al'cng
the Santa Fe Trail in Douglas Co. The monUments were erected by.
the Daughters of the American Revolutio~ in 1906 and 1907. Some 'of
the monuments are now in poor cQndi tion due to' erosion and other '"
factors. ;::,~~S$ BETTS believes that without some outside he 11>. th~.~·
monuments may further deteriorate.
.
Miss :BEr,TS and Katharine KELLgy. ·are in the process of re$toring two /'
of the m:6numents, one honorj;-ng;~t,he former to~n of P~M~A and the .
other about one half mile north of BALDWll\lc CITY. The others in need
of restoration are at the sites of: ':GLOBE.,~·BLACK: JACK. BROOKLYN.
WILLOW SPRINGS, and FLAG SPRINGS. The one that needs'the most work
1s. at BROOKLYN. "It 1,9 just a wooden sign that says "BROOKLYN '".
The sign has iio~. t'o:uniia:'ta:ql}..,,-:, ,

Miss BETTS feels that if something-is 'not done soon to restore these
markers. future generations may not even .know the wher'eabouts of
such places as the long-extinct towns "of BROOKLYN and WILLOW SPRINGS.
She would welcome financial or other kinds of help in continuing her
goal of restoring all seven of the Douglas County markers. "If some
